## 1. Service Presentation

The Who's Right mobile application (hereinafter "the Application" or "the Service") is published by:

### 1.2 Service Description
Who's Right is a debate application allowing users to:
- Participate in real-time or asynchronous debates
- Confront their arguments with other users
- Benefit from artificial intelligence analysis of their arguments
- Access automated sources and fact-checking
- Track their progress and debate statistics
### 1.3 Acceptance of Terms
Use of the Application implies full and complete acceptance of these Terms of Use (hereinafter "Terms"). If you do not accept these Terms, you must not use the Application.
By creating an account or using the Application, you acknowledge that you have read, understood, and accepted these Terms as well as our [Privacy Policy](https://whosright.app/privacy).

## 2. Access to the Service
### 2.1 Registration Requirements
To use the Application, you must:
- Be at least 13 years old
- If you are between 13 and 16, have permission from your parents or legal guardians
- Create an account with a valid email address
- Choose a username that complies with our rules of conduct
### 2.2 User Account
You are responsible for:
- The confidentiality of your login credentials
- All activities carried out from your account
- The accuracy of information provided during registration
If you suspect unauthorized use of your account, you must notify us immediately at contact@whosright.app.
### 2.3 Service Availability
We strive to ensure the availability of the Application 24/7. However, we reserve the right to temporarily suspend access for:
- Technical maintenance
- Application updates
- Force majeure events
We do not guarantee uninterrupted access to the Service and shall not be held liable for temporary interruptions.

## 3. Use of the Service
### 3.1 Rules of Conduct
By using the Application, you agree to:
Respect other users:
- Do not publish insulting, defamatory, or hateful content
- Do not harass or threaten other users
- Maintain a respectful tone even in case of disagreement
Comply with the law:
- Do not publish illegal content
- Do not incite violence or discrimination
- Do not intentionally spread false information
- Respect intellectual property rights
Use the service fairly:
- Do not create multiple accounts
- Do not use bots or automated scripts
- Do not attempt to bypass security systems
- Do not exploit bugs or vulnerabilities of the Application
### 3.2 Prohibited Content
The following content is strictly prohibited:
- Racist, sexist, homophobic, or discriminatory statements
- Apology for terrorism or crimes
- Pornographic content
- Harassment or threats
- Spam or unauthorized advertising
- Identity theft
- Content violating copyright
### 3.3 Moderation and Reporting
#### Moderation System
The Application uses a moderation system combining:
- Automatic filtering by artificial intelligence: messages are analyzed in real time to detect and filter inappropriate content
- Reporting by users: you can report any content or behavior that you consider contrary to these Terms via the report button available in the Application
#### Processing of Reports
When you report content or a user:
- Your report is recorded and reviewed by our moderation team
- The reported user is not informed of the reporter's identity
- We reserve the right not to follow up on a report if we consider it unjustified
- Abusive or repeated reports may themselves be subject to sanctions
#### Sanctions Scale
Depending on the severity and recurrence of violations, we may apply the following sanctions:

| 2 | 7-day suspension | Repeated minor violations or moderate violation |
| 3 | 1-month suspension | Repeated moderate violations or serious violation |
| 4 | 3-month suspension | Repeated serious violations |
| 5 | Permanent ban | Very serious violations or recurrence after 3-month suspension |
Minor violations: inappropriate language, light provocation, light spam
Moderate violations: insults, light harassment, shocking content
Serious violations: repeated harassment, threats, hateful content, identity theft
Very serious violations: apology for terrorism, child pornography, incitement to violence, illegal activities
This scale is indicative. We reserve the right to adapt the sanction according to the context and actual severity of the facts.
#### Notification of Sanctions
In case of a sanction:
- You will be notified by email and/or via the Application
- The reason for the sanction will be communicated to you
- The duration of the suspension (if applicable) will be indicated
#### Effects of a Suspension
During a suspension:
- You cannot access the Application or your account
- Your ongoing debates are paused or attributed to your opponent depending on their state
- Your Premium subscription (or trial period) continues to run: no refund or extension will be granted for the suspension period
#### Appeal
If you believe a sanction is unjustified, you can contest it by contacting us at contact@whosright.app within 15 days of the notification. Your request will be reviewed and we will respond within 30 days. The appeal does not suspend the execution of the sanction.

## 4. Intellectual Property
### 4.1 Publisher's Rights
The Application, its design, source code, logos, trademarks, and content (excluding user content) are the exclusive property of Melvin Zerigue and are protected by French and international intellectual property laws.
Any unauthorized reproduction, representation, modification, or exploitation is prohibited.
### 4.2 User Content
By publishing content on the Application (arguments, debates, comments), you:
- Retain your intellectual property rights over this content
- Grant Who's Right a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute this content for the purpose of operating the Service
- Warrant that this content does not infringe the rights of third parties
This license ends when you delete your content or your account, unless this content has been shared with other users who have not deleted it.
### 4.3 Artificial Intelligence
Analyses, scores, and fact-checks generated by our artificial intelligence system:
- Are provided for informational purposes only
- Do not constitute absolute truths
- May contain errors or inaccuracies
- Do not replace your own critical judgment

## 5. Subscriptions, Free Trial, and Payments
### 5.1 Available Plans
The Application offers several plans:
- Free: limited access to basic features
- Premium: extended access with advanced features (available monthly and yearly)
- Creator: all Premium features + creation options (available monthly)
Details and pricing of each plan are available in the Application. Prices displayed are those communicated by the Apple App Store or Google Play Store and include applicable taxes.
### 5.2 Free Trial Period
#### 5.2.1 Free Trial Conditions
Who's Right may offer a free trial period of 7 (seven) days for Premium subscriptions. The terms of this offer are as follows:
- Eligibility: The free trial is reserved for new subscribers who have never used a free trial within the same subscription group on the Apple App Store or Google Play Store. Eligibility is determined by Apple or Google and may be subject to additional conditions specific to these platforms.
- Duration: 7 calendar days from the activation of the trial.
- Features: During the trial period, you benefit from all Premium subscription features.
- Limit: One free trial per user per subscription group (managed by Apple/Google).
#### 5.2.2 Automatic Conversion After the Trial
At the end of the 7-day trial period, your subscription will automatically convert to a paid subscription at the current rate, unless you cancel your subscription at least 24 hours before the end of the trial period.
- The price that will be charged after the trial is clearly indicated to you before the trial begins.
- No charges will be made during the free trial period.
- You will receive a reminder notification before the end of your trial informing you of the upcoming conversion.
#### 5.2.3 Trial Cancellation
You can cancel at any time during the trial period, free of charge. If you cancel:
- You retain access to Premium features until the end of the 7-day trial period.
- No amount will be charged.
- Your account will revert to Free plan features at the end of the trial period.
To cancel:
- iOS: Settings > [your name] > Subscriptions > Who's Right > Cancel Subscription
- Android: Google Play Store > Profile > Payments & Subscriptions > Subscriptions > Who's Right > Cancel Subscription
#### 5.2.4 Upgrade During Trial
If you upgrade to a higher plan (for example, from Premium to Creator) during the trial period:
- Your free trial ends immediately.
- You will be charged at the new plan's rate upon upgrade.
- No new free trial will be offered for the new plan.
### 5.3 Payment Process
All in-app purchases (subscriptions and one-time purchases) are made through the payment system of the Apple App Store or Google Play Store, depending on the platform used.
By making a purchase, you accept the terms of the relevant platform:
- Apple: https://www.apple.com/legal/internet-services/itunes/
- Google: https://play.google.com/intl/en/about/play-terms/
We do not collect or store any payment information. Transactions are entirely managed by Apple or Google.
### 5.4 Automatic Renewal
Subscriptions (after the trial period or in case of direct subscription) renew automatically at the end of each billing period (monthly or yearly), unless you cancel at least 24 hours before the end of the current period.
The subscription amount is charged to your Apple or Google account at the time of renewal.
To manage or cancel your subscription:
On iOS:
1. Open your device Settings
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select the Who's Right subscription
5. Tap "Cancel Subscription"
On Android:
1. Open the Google Play Store
2. Tap the profile icon
3. Tap "Payments & subscriptions" > "Subscriptions"
4. Select the Who's Right subscription
5. Tap "Cancel subscription"
### 5.5 Refunds
Refund requests must be addressed directly to the platform through which the purchase was made:
- Apple: via the App Store application or the website https://reportaproblem.apple.com
- Google: via the Google Play Store or the website https://play.google.com/store/account/subscriptions
We are unable to process refunds directly for purchases made through the stores. If you encounter difficulties, contact us at contact@whosright.app and we will assist you in your process.
### 5.6 Price Changes
We reserve the right to modify subscription prices. In case of modification:
- You will be informed at least 30 days in advance
- New prices will apply at the next renewal
- You can cancel your subscription if you do not accept the new prices

## 6. Personal Data Protection
### 6.1 GDPR Commitment
We are committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act (Loi Informatique et Libertés).
### 6.2 Data Collected
As part of the Service, we collect:
- Identification data: email, username
- Content data: your arguments and debates
- Usage data: statistics, scores, progression
- Technical data: device identifiers, connection logs
- Subscription data: subscribed plan, billing period, free trial status, subscription dates
### 6.3 Processing Purposes
Your data is used to:
- Provide and improve the Service
- Personalize your experience
- Analyze your arguments (AI)
- Manage subscriptions and trial periods
- Send you notifications (if authorized), including trial expiration reminders
- Ensure the security of the Service
### 6.4 Your Rights
In accordance with the GDPR, you have the following rights:
- Right of access: obtain a copy of your data
- Right of rectification: correct inaccurate data
- Right of erasure: delete your account and data
- Right to portability: receive your data in a structured format
- Right to object: object to certain processing
- Right to restriction: restrict the processing of your data

### 6.5 Account Deletion
You can delete your account at any time from the Application settings. Deletion results in:
- Erasure of your personal data
- Deletion of your debate history
- Loss of your current subscription (without refund)
Important: Deleting your account in the Application does not automatically cancel your current subscription with Apple or Google. You must cancel your subscription separately in your device settings (see section 5.4) to avoid being charged.
Certain data may be retained for legal obligations (billing, disputes) for a limited period.

## 7. Liability
### 7.1 Limitation of Liability
The Application is provided "as is." We do not guarantee:
- The accuracy of analyses and scores generated by the AI
- The truthfulness of sources and fact-checks
- The absence of errors or interruptions of the Service
- Compatibility with all devices
### 7.2 Exclusions of Liability
We shall not be held liable for:
- Content published by users
- Damages resulting from the use or inability to use the Service
- Loss of data
- Decisions made based on AI analyses
- Charges resulting from the user's failure to cancel a subscription or trial period
### 7.3 User Liability
You are solely responsible for:
- The content you publish
- How you use the Service
- The consequences of your interactions with other users
- Managing your subscription (including cancellation before the end of the free trial)

## 8. Modification and Termination
### 8.1 Modification of Terms
We reserve the right to modify these Terms at any time. In the event of a substantial modification:
- You will be informed via the Application or by email
- The new terms will take effect 30 days after notification
- Your continued use of the Service constitutes acceptance of the new Terms
### 8.2 Termination by User
You may stop using the Application and delete your account at any time from the settings. Remember to cancel your subscription with Apple or Google separately (see section 5.4).
### 8.3 Termination and Sanctions by the Publisher
We reserve the right to temporarily suspend or permanently ban your account in case of:
- Violation of these Terms or rules of conduct (section 3)
- Behavior harmful to other users or the Service
- Fraudulent use of the Service
- Multiple and substantiated reports from other users
- Prolonged inactivity (more than 24 months)
The terms of sanctions (duration, scale, notification, appeal) are detailed in section 3.3.
In case of suspension or ban for violation of the Terms:
- No refund of the current subscription will be made
- No subscription extension will be granted
- Access to the Service will be immediately revoked
- In case of permanent ban, any creation of a new account is prohibited

## 9. General Provisions
### 9.1 Applicable Law
These Terms are governed by French law.
### 9.2 Competent Jurisdiction
In the event of a dispute relating to the interpretation or performance of these Terms, and failing amicable resolution, the French courts shall have sole jurisdiction.
For consumers residing in the European Union, you may also use the European Commission's Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr
### 9.3 Partial Invalidity
If any provision of these Terms is declared null or unenforceable, the remaining provisions shall remain in force.
### 9.4 Waiver
Failure to exercise a right provided by these Terms does not constitute a waiver of that right.
### 9.5 Entirety
These Terms constitute the entire agreement between you and Who's Right regarding the use of the Service.
